Penalties
The penalties for drink or drug driving are severe. Even for a first offence, you can expect to lose your licence for at least a year together with a hefty fine or even imprisonment.
Exclusively in Scotland, a second drink or drug driving offence can you result in your car being forfeited, and will be either sold or destroyed.
Drivers disqualified for drinking and driving twice within 10 years, or once if they are over two and a half times the legal limit, or those who refuse to give a specimen, also have to satisfy the Driver and Vehicle Licensing Agency's Medical Branch that they do not have an alcohol problem and are otherwise fit to drive before their licence is returned at the end of their period of disqualification.
Persistent misuse of drugs or alcohol may lead to withdrawal of a driving licence.
| OFFENCE | MAXIMUM PENALTIES | |||
| Imprisonment | Fine | Disqualification | Penalty Points | |
| Causing death by careless driving under the influence of drink or drugs |
14 Years | Unlimited | Obligatory - 2 years minimum | 3 -11 If exceptionally not disqualified |
| Driving while unfit through drink or drugs or with excess alcohol, or failing to provide a specimen for analysis |
6 months | £5000 | Obligatory | 3 -11 If exceptionally not disqualified |
And the consequences don't stop there. When you do eventually get your licence back, your insurance will be much higher than it was before. A drink or drug driving conviction will give you a criminal record which will stay on file for 20 years with the potential to seriously affect your career opportunities and stop you travelling to the USA, even on holiday.
